In November 2025 we wrote about a federal spending bill that would rewrite the definition of hemp and squeeze most intoxicating hemp-derived products out of the Farm Bill lane. That original effective date was November 12, 2026.
As of early September 2026, Congress and the White House moved most of that deadline. Here’s the short version of where things stand for Mainstream CBD customers.

What just changed

Important: this is a calendar delay, not a repeal. The underlying law from November 2025 (P.L. 119-37, Section 781) is still on the books.
What the law actually does
- Total THC, not delta-9 alone. Hemp is measured by total THC (including THCA), capped at 0.3% by dry weight. Products that relied on a low delta-9 number while carrying high THCA are the ones most affected.
- 0.4 mg per container. Finished hemp-derived cannabinoid products with more than 0.4 milligrams of total THC (plus similarly acting cannabinoids as determined by HHS) per container fall outside the federal hemp definition. For scale: a single 5 mg gummy is already many times that limit.
- Synthetics stay on the early date. Cannabinoids that are not capable of being naturally produced by the cannabis plant still lose federal hemp status on November 12, 2026. That carve-out was not delayed.
Two deadlines to remember
- November 12, 2026 — synthetic / non-plant-capable cannabinoids.
- December 11, 2026 — total THC standard + 0.4 mg per-container cap for most other hemp-derived cannabinoid products (unless Congress changes course again).
What this means in Minnesota
Minnesota already uses a total-THC approach for cannabis and hemp retail. That is separate from the federal Farm Bill rewrite. Even if a product is labeled “federally legal hemp,” Minnesota’s own rules still apply in-store and for local sales.
Practical takeaway for shoppers: always check the COA, know whether you’re buying a hemp-derived product or a state-regulated cannabis product, and don’t assume an out-of-state shipping claim overrides Minnesota law.
